NYC Clerk Defends Himself Against Violent Attacker and Goes to Jail, but Shooting a Cop Is Ok?

Jose Alba, a Bronx clerk, was 51 years old when he fought off an attacker with a knife and killed him. Alba is now in Riker’s Island jail.

The Backstory:

A woman tried to buy a bag of chips using an Electronic Benefits Transfer debit card. Alba gave the chips to her. Alba gave her the chips back when the EBT card returned with insufficient funds. The woman became mad and began to steal items from the counter. She then ran off to find her boyfriend, Austin Simon.

Many videos have appeared on social media that show angry customers creating chaos in restaurants and stores.

Ten minutes later, the woman, 33, returned with Simon. Simon ran behind the counter to confront Alba. Alba presented Simon with the receipt, stating that the woman’s card had been declined. This didn’t help.

Simon then forced Alba into a chair and began to rant at him. Alba tried to get past Simon, but Simon grabbed Alba and Alba grabbed a knife.

Austin Simon is known to have been arrested on eight charges, including domestic assault, assault, and robbery. After being sentenced to assaulting a police officer, he was released on parole.

Alba attempts to flee but Simon doesn’t allow him. The fight ensues, and Alba stabs Simon. Simon’s girlfriend then attacks Alba with her knife. Alba is seen with a deep cut to his arm after the fight is over.

Simon was taken to the hospital and declared dead.

Surprisingly, Alba was charged with second-degree murder and is currently being held on $250,000. He doesn’t actually have that amount. His past arrests are not relevant. Alvin Bragg (Commie District Attorney) was a strong advocate for $500,000 bail. Many people are calling for his firing because of his extreme-left treatment of violent criminals. Simon’s girlfriend was not arrested, even though Alba was attacked with a knife.

Alba’s family created a GoFundMe account to help pay legal costs. It had raised almost $20,000 but GoFundMe quickly deleted it. The family created a new profile on GiveSendGo.

The public reacted quickly to the outrage. Eric Adams, NYC Mayor, expressed condolences. However, he did not comment on DA Bragg’s decision to indict Alba for second-degree murder.

“My heart goes out to the employee who was in the store doing his job,” Adams told a reporter from the New York Post. “I am hoping that we take all of that into consideration, as this hard-working New Yorker was doing his job, and someone aggressively went behind the counter to attack him.”

Alba could spend 15-25 years behind bars if convicted.
