This Is Why ‘Assault Weapons’ Laws Are Stupid – The People Who Write Them Know Nothing About Guns

Here’s the problem with pretty much every gun law ever proposed, all the way back (at least) to the 1934 National Firearms Act: The people who write them don’t know anything about guns. Case in point: The infamous federal 1994 “Assault Weapon” ban, which didn’t ban anything and didn’t accomplish anything. The 1994 law banned certain cosmetic features of those rifles, like flash hiders and bayonet lugs; gun makers quickly started selling “post-ban” models with no flash suppressors and bayonet lugs, which made them perfectly legal.

And bayonet lugs? Seriously?  Bayonet lugs? When was the last time you heard of a drive-by bayoneting? I suppose all those opposing street gangs fixing bayonets and closing to hand-to-hand range promoted that particular piece of stupidity.

Now, as my colleague Bonchie reported on Thursday, the state of Colorado has passed yet another “assault weapons” law that will no doubt be struck down in the post-Bruen world.

On Thursday, Gov. Jared Polis signed a law that bans the production and most sales of semi-automatic firearms with detachable magazines. That means the gun control measure not only covers semi-automatic rifles like the AR-15 (which would be bad enough on its own) but also makes essentially all modern-day handguns illegal as well.

This law is more comprehensive than many, although it allows a work-around for people who are willing to take a “safety course” and undergo (another?) background check to purchase a “banned” firearm. The new Colorado law allows the list of banned weapons to be sold as before if they are modified to fire from a fixed, not a detachable, magazine.

As I noted above, this law is unlikely to survive a court challenge. These are guns that are, in fact, in common use.

But more and more blue states keep trying this. Here, thanks to these midwits who can’t be arsed to actually learn anything about guns, is the reply: A semi-auto rifle platform that uses the AR-15 upper receiver, functions like an AR-15, uses the same ammo fed from the same magazine as the AR-15, and is legal in all fifty states (except, possibly, now Colorado.)

Now that’s an interesting concept, and note that the differences between this rifle and the AR-15s in my gun safe – yes, my wife has one, too – are all cosmetic. They function identically. They use the same ammo. Of course, you can’t fix a bayonet on the SCR, but that’s no great loss. 

This is why gun bans never accomplish anything. And there’s an even greater flaw that these people will never understand: A firearm isn’t a terribly complicated instrument. You can build a functional, if crude, weapon in most well-equipped basement workshops, and if you have a mill and a metal lathe, you could build a pretty effective piece; no 3-D printing required. And the easiest kind to build would be a small submachinegun, on the order of a MAC-10, a Sten, or an M3 “grease gun.”

And, as I’ve said for many years, if I had a choice between getting in a fight with a 20-something gangbanger with an AK he’s fired twice and a 75-year-old sourdough with a Winchester .30-30 he’s been shooting and hunting with for 60 years, I’ll go up against the gang-banger every time, as the old man is going to be far, far more dangerous. 

And that’s the other thing that the gun banners will never understand.
