More Drama in the Paul Pelosi Case as Prosecutor Back Pedals on Language in Charge

Paul Pelosi was taken before the court on Wednesday. His attorney appeared on his behalf, but he was not present during the proceedings.

Now, the prosecutor wants to clarify the language in Pelosi’s first charge. That was the charge Pelosi faced in her first case:

On or about May 28, 2022, in the County of Napa, State of California, the crime of D.U.I. CAUSING INJURY, in violation of section 23153(a) of the Vehicle Code, a misdemeanor, was committed by PAUL PELOSI, who did unlawfully, while under the influence of an alcoholic beverage and a drug and under their combined influence, drive a vehicle and in so driving, concurrently did an act forbidden by law and neglected a duty imposed by law which proximately caused bodily injury to John Doe.

Fox News Assistant district attorney Paul Gero stated that the complaint was full of boilerplate language. Our theory is alcohol.

This appears to have been section 23153 (a)’s boilerplate language. It seems to be missing the first phrase which includes the “or”.

Driving a vehicle under the influence of alcohol or drugs is illegal.

Some suspect that the prosecutor is trying to hide or backtrack on the charges.

But, you have an unstated accusation that doesn’t match their theory. If the charge is not amended, it could prove problematic.

Second offense: Driving while intoxicated with 0.08 alcohol or more.

Officials are yet to release footage from the body camera, but we were able to get more information when the California Highway Patrol report was published

The report states that he displayed “signs of impairment” while being tested. They observed “objective symptoms and signs of alcohol impairment, including red/watery eyes and speech slurred. He also had strong odors emanating from his mouth. ”

The other diver suffered from injuries the day following the crash. He began feeling pain in his right upper arm and right shoulder. He stated that it was difficult to lift heavy objects with his right hand.

Pelosi is also alleged to have pulled out a California Highway Patrol 11-1999 Card in an attempt to curry favor with officers. It stated that it would review Pelosi’s membership.

The California Highway Patrol 11-99 (CHP 11-99) Foundation confirmed that any member who brings their name or property into law enforcement contact is in violation of the group’s terms and conditions agreement. The foundation noted the part of its policy that states that attempting to use membership in exchange for “preferential treatment” in any contact with police will result in immediate termination.

“We will await the outcome of this trial and will evaluate Mr. Pelosi’s membership status once we have all of the facts,” Laura Reed, a spokesperson for the group, told Fox News Digital in an email. “If it is proven he violated our terms and conditions, we will revoke his membership and we would request that all membership items be returned as they are property of the 11-99 Foundation.”

Would it be normal for him to pull out the card hoping it will help?

Paul Pelosi will be appearing in court on August 23.

Here is a Tweet I found that is going around stating that Paul Pelosi’s mugshot that the public was putting out was altered and here is what his real mug shot is said to look like:
